It is seen that publication has been effected as per the order dated 28.07.2021. The copy of the publication has also been produced. None appears for the first defendant. The first defendant called absent set ex-parte. The counsel for the second defendant would submit that the Company namely eBay India Pvt. Ltd., has wound up its operations in India with effect from 15.08.2018 and they are not operating their website any more. In view of the same, the suit against the second defendant is dismissed.
- The Registry is directed to list the suit for ex-parte evidence as against the first defendant, before the learned Additional Master No.I, on 20.09.2021.
