On application being filed, subpoena was directed to a third party / Sea Records to tender evidence on behalf of the defendants. The batta had been paid. But the bailiff had returned the Notice unserved with the endorsement there is no such Office by the name Sea Records in the address given.

It is therefore futile to expect the said third party / Sea Records to make themselves available to tender evidence before this Court. The suit will now have been to proceed. D.W.1 has to be examined in chief and cross examined.

The learned counsel for the defendant stated that D.W.1 is at Mumbai. A Case Management Schedule should be filed indicating the date on which D.W.1 would be examined in Chief and also cross examined.
