O R D E R
The petitioner has filed this writ petition seeking issuance of Writ of Mandamus directing the third respondent to consider the representation dated 11.04.2014 and also to direct the third respondent to cancel the patta issued in favour of fifth respondent.
2.The case of the petitioner is that properties in S.Nos.357/1A, 363/1, 362/2A, 365/2 and 367/3B an extent of 1.78.50 hectares are the petitioner's ancestral properties and her father acquired the same by way of partition deed dated 15.06.1995. Thereafter the petitioner's father passed away on 26.05.2000 leaving behind the petitioner, her mother and her brother/ fifth respondent as his legal heirs. Whileso, the fifth respondent obtained patta in respect of the subject property in his name by suppressing the name of the petitioner. Hence, the petitioner made representation to the respondents seeking to cancel the patta issued in favour of the fifth respondent and since the same has not yet been considered, has filed this writ petition.
3.The learned counsel appearing for the petitioner submitted that this Court may issue direction to the third respondent to consider the petitioner's representation dated 11.04.2014 and to pass appropriate orders within a reasonable time frame.
4.Considering the limited request made by the learned counsel appearing for the petitioner, this Court, without expressing any opinion on the merits of the case, directs the third respondent to consider the petitioner's representation dated 11.04.2014, on merits and in accordance with law and after affording opportunity to the fifth respondent, pass appropriate orders, within a period of twelve weeks from the date of receipt of a copy of this order.
5.This writ petition is accordingly disposed of. No costs.
