Order Text

W.P.No.13657 of 2020 and W.M.P.Nos.16980 & 16982 of 2020

R. SURESH KUMAR, J.

In this writ petition, the prayer sought for is as follows.

"Writ of Mandamus to direct the Respondent 1 to 3 to i) furnish the list of employees opted to pay subscription to the Petitioners by 8th every month and finalise the list by 20th of same month by considering the objections if any submitted by the Petitioners ii) furnish the list of employees from whom the subscription on the date of salary remitted in favour of the Petitioners in order to enable the Petitioners to reconcile their accounts and also know as to who had remitted subscription to them."

  1. Mr.K.Srinivasa Murthy, learned counsel for the petitioner submits that, the very same issue has already been dealt with by this Court in respect of another Bank viz., Canara Bank in W.P.Nos.34160 and 34258 of 2019, by an order of the learned Judge dated 02.01.2020. Exactly the same issue has been raised in this writ petition and therefore, he would submit that, there can be no possible objection from the Bank for the prayer sought for in the writ petition, which is innocuous in nature in view of the judgment already made in this regard on the very same issue.

  2. However Ms.Hemalatha, learned representing counsel appearing for the respondent Bank submits that the counsel on record Mr.V.Suthakar could not appear before this Court today due to some personal inconvenience and hence she wants short accommodation.

  3. It is made clear that already the counsel on record for the respondent Bank took notice on 30.09.2020. By this time, if at all any possible objection is available from the Bank, they could have filed a counter. But, so far no counter has been filed. At any rate, now due to the personal inconvenience of the counsel, one day accommodation as sought for by the counsel for the respondent bank, is granted.

  4. Post the matter tomorrow (05.11.2020) under the caption "For Orders."
