Prayer: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the records pertaining to the impugned order of the second respondent in Na.Ka.No.1194/2017/MC7 dated 29.09.2017 and quash the same as illegal and consequently, direct the second respondent to provide the petitioner some adequate time that may be fixed by this Hon'ble Court to vacate the residential quarters occupied by the petitioner in the Coimbatore Municipal Corporation Seethalakshmi Maternity Hospital Campus, Coimbatore.

The petitioner was working as a Sanitary Inspector in the office of the second respondent /Coimbatore Municipal Corporation and now he has been transferred to the third respondent /Erode Municipal Corporation. The petitioner was also directed to hand over the official quarters within a month's time. However, the petitioner gave a representation dated

31.07.2017 seeking more time. But by a proceedings dated 23.09.2017, the Commissioner, Coimbatore Municipal Corporation has granted one month time from 01.08.2017 to 31.08.2017 and finding it difficult, he has filed this writ petition.

3.The learned counsel appearing for the petitioner pointing out the date of signing of the order dated Nil.09.2017 on 23.09.2017 submitted that the respondents should be directed to give sufficient time to vacate the official quarters.

4.I have perused the said order. The petitioner was transferred from Coimbatore Municipal Corporation to Erode Municipal Corporation on 28.07.2017. The proceedings dated Nil.09.2017 signed on 23.09.2017 also shows that he has been given sufficient time. Hence, this Court hereby grants only 30 days more time to vacate and hand over the official quarters and if the petitioner fails to surrender, the respondents are granted liberty to initiate departmental proceedings against him.

5.Accordingly, the writ petition stands disposed of accordingly. No costs. Consequently, connected miscellaneous petitions are closed.
