This Criminal revision is filed under Section 397 read with 401 of Cr.P.C., to call for the records and set aside the order dated 25.01.2011 passed in M.P.No.2860 of 2009 agaisnt C.C.No.6932 of 2005 on the file of the learned XI Metropolitan Magistrate, saidapet, Chennai.

O R D E R

This revision has been filed as against the order passed by the learned XI Metropolitan Magistrate, Saidapet, Chennai, dismissing the petition filed by the petitioner/accused under Section 245 Cr.P.C to discharge the petition from the charges levelled against him.

  1. The respondent has filed a private complaint under Sections 420, 468, 471 and 474 IPC.

  2. The learned Metropolitan Magistrate after taking cognizance, ordered summons to the petitioner. Thereafter, the petitioner entered appearance and filed a petition under Section

245 Cr.P.C., seeking to discharge him from the charges levelled against him. The learned Judicial Magistrate dismissed the application, against which, the present revision has been filed.

  1. Today when the matter was taken up, the learned counsel appearing for the petitioner as well as the respondent submitted that pending revision, both the parties have settled the issues between themselves and the respondent/complainant received a sum of Rs.65,00,000/- from the petitioner/accused. The learned counsels also produced a memorandum of understanding to that effect. Today both the complainant and accused are present. The complainant acknowledged the receipt of the amount and submitted that he is not interested in prosecuting the criminal case further.

  2. In the above circumstances, since the matter has been settled between the parties and the complainant has also received the entire amount, all further proceedings in C.C.No.6932 of 2005 pending on the file of XI Metropolitan Magistrate, Saidapet, Chennai is quashed.

  3. Accordingly, this Criminal Revision Case is allowed and the memo of understanding filed by both sides shall form part of the record. Consequently, connected miscellaneous petition is closed.
