Heard both sides and perused the pleadings. The following issues are framed for consideration of the suit :

• 1. Whether the plaintiffs are entitled to the reliefs of declaration of the settlement deed dated 09.11.1990 as null and void and not binding on the plaintiffs?
• 2. Whether the plaintiffs are entitled to a preliminary decree for partition of their 5/12th share in the suit schedule property by metes and bounds?
• 3. Whether the plaintiffs are entitled to the relief of permanent injunction against the defendants, restraining them from alienating or encumbering the schedule property?
• 4. Whether the plaintiffs are entitled to the relief of permanent injunction against the defendants, restraining them from making any construction or developmental activity in the schedule property?
• 5. Whether the suit is bad for mis-joinder of parties and non-joinder of necessary parties?
• 6. Whether the suit is properly valued?
• 7. Is the suit barred by limitation?
• 8. To what other reliefs are the plaintiffs entitled to?
