This Court by order dated 20.04.2021, directed the defendant to furnish security to the tune of Rs.1,31,00,000/- within a period of six weeks. The defendant entered appearance through counsel and sought extension of time and that was also granted by this Court fixing 20.07.2021, as the last date for furnishing security. The respondent has not furnished the security, however, taken out an application to reject the plaint for want of jurisdiction.

2.This Court is of the view that this application to reject the plaint is filed on 16.07.2021, after the order passed by this Court on 05.07.2021, extending the time to furnish security on or before 20.07.2021. This Court finds that there is no bonafide intention on the part of the defendant. Hence, it is open to the applicant/plaintiff to take appropriate legal course in view of the failure on the part of the respondent to furnish security as ordered by this Court.
