This application is filed for condonation of 328 days' delay caused in filing present appeal against judgment and award dated 30th March, 2015 passed by Civil Judge (Sr.Dn.), Yavatmal in L.A.C.No.64 of 2010.

For the grounds mentioned in para nos.4 and 5 of the application, as delay caused is found satisfactorily explained, though application is opposed by respondent, same is allowed in the interest of justice. Civil application is disposed of as allowed.

CIVIL APPLIATION (CAF) 2057 OF 2017.

This application is filed by appellant for grant of stay to effect and operation of impugned judgment and award passed in L.A.C.No.64 of 2010 by Civil Judge (Sr.Dn.), Yavatmal on 30th March, 2015, contending that entire decretal amount is deposited with the Registry of this Court.

Record reveals that by order dated 11th July, 2017 this Court had granted interim stay subject to appellant depositing entire decretal amount within a period of 12 weeks from the date of order. Office note reveals that amount of Rs.14,54,511/ is deposited with the Registry of this Court. In that view of the matter, interim stay is confirmed pending appeal. Civil application is disposed of as allowed.

Appellant to place on record paperbook within six months.
