  1. Heard.

  2. Learned counsel for the applicant submits that in the first information report assault by only two persons indicated by the informant, however, later on supplementary statement came to be recorded. It is stated that there were four persons who are involved in the said incident. Thus, according to the learned counsel for the applicant there is improvement in supplementary statement in order to falsely implicate others in this crime.

  3. Having regard these facts, liberty of the applicant is protected till the prosecution is heard in the matter. Hence the following order:

ORDER

(i) Till the next date, in the event of arrest of applicant

in connection with Crime No. 198/2023, registered with Vimantal Police Station, Dist. Nanded for the offences punishable under Sections 307, 324, 323, 504, 506 r/w 34 of IPC and Sections 4/25, 5/25 of Arms Act, he shall be released on bail on furnishing PR Bond of Rs.15,000/- (Rupees Fifteen Thousand only) with one surety in the like amount.

(ii) He shall attend the concerned police station once in a week.

(iii) He shall not contact the witnesses directly or indirectly.

(iv) He shall not interfere with the evidence in any manner whatsoever.

(v) He is further directed to cooperate the investigating agency for further investigation.

  1. Issue notice to the respondent, returnable on 7th November, 2023.

Learned APP waives service of notice for respondent/State.
