Mr. Beedkar, learned advocate for the respondent refers to that Miscellaneous Civil Application Stamp No.33204 of 2016 has been lodged by the respondent seeking transfer of Regular Civil Suit No.344 of 2016 filed by applicant in the court of civil judge, senior division, Latur to a court at Ambajogai and requests that both the miscellaneous civil applications be taken up together. Learned advocate for the applicant does not have any particular resistance to the request.

As such, present miscellaneous civil application be placed with miscellaneous civil application stamp No.33204 of 2016.

Since, learned advocate for the applicant refers to that the applicant has no notice of miscellaneous civil application stamp No.33204 of 2016, he may not get power to appear in said matter.

As such, put up both the matters on 29th November, 2016. By then, it is expected that learned advocate for the applicant may receive instructions in respect of miscellaneous civil application stamp No.33204 of 2016.

In the meanwhile, on instructions, learned advocates state that the parties have expressed their willingness to explore possibility of resolution of inter se dispute through mediation and further agree upon Mr.K. B. Chaudhary, learned advocate, to be their mediator.
