The application for rejection of plaint is rejected. Aggrieved thereby the present Writ Petition is filed.

Heard Mr. Talhar, learned counsel for the petitioner.

The Court has rejected the application on the ground that at this stage the same would not be tenable as the present respondent has already adduced his evidence.

No doubt, the application for rejection of plaint can be considered at any stage of the proceedings. However, considering the fact that the respondent has adduced evidence, I am not inclined to entertain the Writ Petition.

The contention raised by the petitioner can be considered by the competent authority at the time of final disposal of the proceedings.

The Writ Petition is dismissed. No costs.
