  1. By the present Interim Application, the Applicant seeks a post grant amendment to the Schedule-I of Testamentary Petition No.698 of 2003.

  2. Learned Counsel for the Applicant points out from the Interim Application that after grant, it was found that certain shares standing in the name of the deceased, as more particularly set out in Exhibit 'C' to the Interim Application, were omitted to be mentioned in the original Schedule-I of the Testamentary Petition. He submits that this fact only came to light when the Applicant noticed the extension order and thus at that time, it was found that the shares were omitted to be mentioned on account of oversight.

$3.$ I have heard learned Counsel, perused the Interim Application and find that there is no impediment in allowing the same. The Interim Application is therefore allowed in terms of prayer clauses (a) and (b), which read as follows :-

  • that this Hon'ble Court be pleased to allow the amendment in $(a)$ Schedule-I of the Petition and Grant of Succession Certificate dated $6^{th}$ day of November, 2020 of the Petition as per Exhibit – 'C' being the Schedule annexed with Rider – II hereto;
  • $(b)$ That this Hon'ble Court be pleased to allow the consequential amendment."

$4.$ Amendments to be carried out within a period of two weeks, i.e., on or before $28/03/2023$ .

$5.$ Interim application is thus disposed of in terms of the above order.
