P.C.: 1. Perused Petition which is filed online. Heard Ld. Advocate for the Petitioner. This Petition is for Probate of Last Joint Will and Testament of the deceased filed by the Petitioner Ruby Jasdeep Gill, the Secretary of Radha Soami Satsang Beas, Bandra, Mumbai Centre, being one of the Executrix named under the Will of the deceased. Deceased Suresh Gopaldas Saney, said to have died at Mumbai on 15.05.2022. Copy of death certificate is annexed to the Petition. For identification proof of the deceased, copy of Pan Card is annexed to the Petition.

  1. Ms. Supe, Advocate for the Petitioner submits that deceased left behind him last Joint Will and Testament which was duly executed at Mumbai on 31.07.2012 and registered at Mumbai on 03.08.2012. The said Will is in English language.
  1. Ms. Supe, Advocate for the Petitioner submits that deceased was governed under the Hindu Succession Act 1956. It is submitted that the parents of the deceased pre-deceased the deceased. The deceased died leaving behind his widow and two daughters. Save and except as mentioned in para – 6 there are no other legal heirs left by the deceased.
  1. Petitioner's Oath is filed. The other Executor, Shyam Kishanchand Totalani has

filed Affidavit dated 07.07.2023 renouncing his right as Executorship. Consent Affidavits of widow and two married daughters of the deceased as mentioned in para – 6 are on record. Affidavit of Manoj Khemchand Bhatia, one of the attesting witness to the Will is filed. Affidavit of service of General Citation is filed. All the other Affidavits are also filed online. All other legal formalities are complied with. Hence, Petition is granted.

  1. Office to issue Probate as prayed after verifying whether any Cross Petition or Caveat is filed.
