This Notice of Motion is taken out by the Insolvent seeking directions against Income Tax Department for raising of attachment of assets of the Insolvent available with the Bombay Stock Exchange and other reliefs. So far as directions sought against Income Tax Department are concerned, this court, by its order dated 17 September 2019, has already recorded a statement of learned Counsel for Bombay Stock Exchange that the amount of the Insolvent lying with Bombay Stock Exchange shall be disbursed by the Defaulters Committee of the Exchange to the various claimants of the insolvent brokers, and that surplus, if any, shall be paid to the defaulter broker. Learned Counsel for the Applicant Insolvent informs the court that some claims against the Insolvent have been paid by the Defaulters Committee under advice to the Insolvent, but that a complete statement in that behalf from the Stock Exchange is awaited. Hence, this Notice of Motion is stood over to 3 March 2020.
