1. As far as Defendant No.1 is concerned, the Plaintiff is allowed to withdraw the Summons for Judgment with liberty to take out a fresh Summons for Judgment after amending the plaint.

2. Defendant No.2 is granted unconditional leave to defend the suit.

3. The suit is transferred as against Defendant No.2 to the list of commercial causes.

4. Defendant No.2 to file its written statement within four weeks from today.

5. Discovery and Inspection to be completed within six weeks thereafter.

6. Summons for Judgment as against Defendant No.2 stands disposed of accordingly.
