Learned Advocate Mr. Siddharth Karpe in Interim Application No. 2430 of 2023 submitted that learned Senior Advocate Mr. Kumbhkoni is going to argue this application. But he is busy in part heard matter before Hon'ble Chief Justice.

Learned Advocate Mr. Kadam in Interim Application No.2225 of 2023 insisted that let Applicant be directed to give attendance to the Police station. Even he submitted that the Applicant Deepak Deshmukh was denied bail by Special Court, Mumbai in ED Case.

Learned APP submitted that both the Applicants are attesting witnesses to the alleged gift deed. The gift deed is shown as executed on behalf of Shri Shivaji Education Society, Kolhapur as a donor and Shri Shivaji Education Society, Dharwad as a donee. Learned APP submitted that even though earlier attendance was given, Police wants to interrogate them in respect of documents prepared at the time of gift deed.

Mr. Kate submitted that in fact father of the Deepak Deshmukh is accused in ED case and Applicant Deepak is only asked to remain present in ED offence and the services of ED are misused accused Applicant Deepak has filed Writ Petition for issuing directions to register FIR and one of the such proposed Accused is intervener Udaykumar Gore. Learned Advocate for Udaykumar Gore submitted that in fact his client is not named in that petition.

Considering the submissions and the reason stated for attendance, let both the Applicants to give attendance to Waduj Police Station on 27th August 2024 from 10:00 to 12:00 noon and
4 th September 2024 from 10:00 to 12:00 noon.
