1] Heard the learned counsel for the Applicant and the learned APP for the State.
2] By order dated 21.05.2014, the 3rd Additional Sessions Judge, Thane, has declined anticipatory bail to the Applicant, inter alia on the ground that the Applicant had failed to observe the conditions imposed by the Court upon her whilst granting interim anticipatory bail.
3] The learned counsel for the Applicant submits that the Applicant had in fact attended the police station and she also has the necessary endorsement from the police station as regards the factum of her attendance. He submits that there was some gap in communication between the Applicant and her counsel and as such these records could not be presented before the Sessions Court.
4] The learned counsel for the Applicant also pointed out that the Applicant's husband who had been arrested in connection with the same offences has already been enlarged on regular bail.
5] Taking into consideration the aforesaid, interim protection can be extended to the Applicant, which the Applicant shall have to scrupulously abide by.
6] Accordingly, in the event the Applicant need to be arrested, she shall be released on interim bail subject to following conditions:
- (a) The Applicant shall furnish a Personal Bond in an amount of Rs.25,000/- (Rupees Twenty Five Thousand);
- (b) The Applicant shall furnish two sureties in the like amount, out of which, at least one of the sureties shall be a local;
- (c) The Applicant shall join in the investigation and refrain from making any attempts to either flee from justice or to tamper with evidence.
- (d ) The Applicant shall report to the concerned police station on every Monday and Friday commencing from 02.06.2014 between 10.00 a.m. to 12.00 noon.
7] Needless to add that the State shall be at liberty to apply in case the Applicant breaches any of the aforesaid conditions.
8] The aforesaid interim protection shall operate until 19.06.2014, by which date the matter may be posted for regular hearing.
9] Stand over to 19.06.2014.
10] Parties to act on the basis of an authenticated copy of this order.
