S/Shri Devashish Mitra with Vijay Badgujar, Raja Bhura and Sachin Chikar i/b M/s. Singhania Legal Services for the Appellants. Shri Rajesh More, APP, for the State.

CORAM: R.C. CHAVAN, J.

DATED: JULY 04, 2011

P.C:

In this application for leave to file appeal against refusal of the Company Law Board to look into a complaint of the offence punishable under Section 340 of the Cr.P.C., what has been revealed is that stamp paper of Rs.100/- bearing serial No.BC-544060, which is annexed at page 117 of the compilation, was issued by the Stamp Office to M.S.S.I.D.C. Limited on 29-5-2008 in response to requisition dated 28-5-2008. The M.S.S.I.D.C. Limited shows that the stamp paper was sold on 4-8-2008 to one Mr. M.E. Joe, Advocate High Court. However, the stamp paper bears rubber stamp of 8-4-2008 and also 1-4-2008 under the signature of some M.D. Kadam. Apart from the question about submitting false documents before the Company Law Board, there is a question as to whether fake stamp papers are under circulation which the learned APP promises to look into.

List the matter on 18-7-2011.

(R.C. CHAVAN, J.)
