The impugned order dated 10.11.2015 passed by the Competent Authority, Konkan Division, Mumbai and order dated 11.04.2016 passed by the Additional Commissioner, Konkan Division is stayed on following condition:
a. The petitioners are restrained by an order of injunction from creating any third party right, title and interest in respect of the suit premises i.e. Flat No.32B, 4th Floor, Sarita Apartment, 218, B.J. Road, Bandra (W),
Mumbai400050 till hearing and final disposal of the Writ Petition.
b. The petitioner to deposit monthly compensation in the sum of Rs.80,000/ p.m. in the Registry of this court, from the date of order passed by the Additional Commissioner, Konkan Division i.e. from April 2016 till hearing and final disposal of the Writ Petition, in the Registry of this court.
c. Arrears to be deposited on or before 07.06.2016 in the Registry of this court.
d. The petitioner to deposit monthly compensation for subsequent period on or before 10th day of each month from June 2016 till hearing and final disposal of the Writ Petition.
e. If there is any default on the part of the petitioner in depositing the monthly compensation, liberty granted to the respondent to move for appropriate orders for vacating the interim protection.
f. If amount is deposited as stated hereinabove, the Registry of this court is directed to invest the same in a fixed deposit account of any Nationalized Bank, initially for a period of one year and same shall be renewed from time to time till hearing and final disposal of the Writ Petition.
g. Considering the facts and circumstances of the present case, hearing of the Writ Petition is expedited.
h. The learned counsel for the respondent waives service.
