IN THE HIGH COURT OF JUDICATURE AT BOMBAY CRIMINAL APPELLATE JURISDICTION

CRIMINAL APPLICATION NO. 352 OF 2016 IN ANTICIPATORY BAIL APPLICATION NO. 1046 OF 2015

Ashok Vishwanath Hiremath … Applicant.

V/s.

The State of Maharashtra … Respondent.

Mr. Shyam Kalyankar, Advocate for the Applicant. Mr. Deepak Thakre, A.P.P. for the Respondent – State.

CORAM : A. M. BADAR, J. DATE : 11th AUGUST, 2016

P.C. :

1 By this application, the applicant/accused is praying for relaxation of condition no.2 of the order 15th March, 2016 in ABA No. 1046 of 2015.

2 Heard the learned counsel appearing for the applicant. He submits that as yet the chargesheet has not been filed and the applicant/accused he is attending the police station on every Saturday, without any reason as no interrogation is done from him since long. Heard learned APP.

3 It is seen that the offence is punishable under section 304 of the Indian Penal Code. While enlarging the applicant on bail, this court had directed the applicant to attend police station on every Saturday between 10 a.m. to 12 noon. The offence is of the year 2015 and as yet the chargesheet is not filed. Condition no. 2 to that effect is therefore, modified and now the applicant should attend the concerned police station as and when reasonably called by the Investigating Officer.

4 With this order, the application is disposed of.
