  1. Heard learned counsel appearing for the applicant. Office note shows that intimation has been sent to the first respondent of the date fixed as per order dated 24th November 2011. First respondent appearing in person not present.

  2. Perusal of the Judgment of the Appellate Court primafacie shows that all the instances relied upon by the original plaintiff were rejected by the Court. Notwithstanding the rejection of the instances produced by the plaintiff, mesne profits have been fixed at the rate of Rs. 90 per square feet per month, though agreed rent was at the rate of Rs.12 per square feet per month. Hence arguable questions are raised.

  1. Rule. Rule on interim relief made returnable on 23rd February 2012. As a sum of Rs.30,95,532/ has been already deposited, adinterim relief granted earlier deserves to be continued. Accordingly it is directed that, adinterim relief granted on 24th November 2011 will continue to operate till further orders.
