Issue notice to the respondent No.2, returnable on 17th February 2021.

In addition to Court notice, the applicants are also permitted to serve respondent No.2 by private notice and after the respondent No.2 is duly served, to file an affidavit-of-service in Registry before the returnable date.

2. Mr. Desai, learned counsel for the applicants submitted that, applicants are original accused Nos.5 and 8 respectively. He submitted that, in the entire complaint no specific overtact is attributed to the applicants with respect to the day to day affairs of M/s. Tecpro Systems Limited, i.e. original

accused No.1. He further, on instructions submitted that, applicants were appointed as independent non executive Directors by the said company and the said fact can clearly be descerned from the Corporate Governance Report for the year 2013-2014 of the said company which is annexed at page No.51 of the Application.

3. In view thereof, ad-interim relief in terms of prayer Clause (b) qua applicants only.

4. Stand over to 17th February 2021.
