Petition under Section 438 of Cr.P.C .praying that in the circumstances stated in the memo of grounds filed herein, the High Court may be pleased to enlarge them on bail in anticipation of their arrest in Crime No.111 of 2013 on the file of Seethanagaram P.S., Rajahmundry Urban, East Godavari District and petitioners abide by the condition or conditions that might be imposed by this Hon'ble Court.

The petition coming on for hearing, upon perusing the Petition and the memo of grounds filed herein, and upon hearing the arguments of Sri M. Sivananda Kumar, Advocate for the Petitioners and of the Additional Public Prosecutor for Respondent- State, the Court made the following

ORDER:-

"This Criminal Petition is filed under Section 438 Cr.P.C., seeking to enlarge the petitioners on bail in the event of their arrest in connection with Crime No.111 of 2013 on the file of Seethanagaram P.S., Rajahmundry Urban, East Godavari District, which was registered for the offences punishable under Sections 324, 354, 506 and 34 IPC.

Heard both sides.

The petitioners are alleged to have abused the defacto complainant and his wife and beat them. The $1^{st}$ petitioner is alleged to have beat with iron road and caused bleeding injuries. The $2^{nd}$ petitioner is aged 68 years. Having regard to the age of the $2^{nd}$ petitioner, I am inclined to grant bail to the $2^{nd}$ petitioner.

Accordingly, the 2<sup>nd</sup> petitioner is directed to surrender before the investigating officer within two weeks from today and on such surrender, he shall be released on bail on his executing personal bond for Rs.5,000/- with two sureties for the like sum to the satisfaction of the arresting officer. As far as the 1<sup>st</sup> petitioner is concerned, he may surrender before the concerned Magistrate and seek regular bail. In the event of such surrender, the same may be considered by the concerned Magistrate on the same day. Subject to the observations made above, the petition stands dismissed in so far as 1 st petitioner is concerned.

Accordingly, the criminal petition is partly allowed."
