HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.43558 OF 2016
ORDER:
This writ petition is filed to declare the action of the 3rd respondent in not filling up the remaining vacant seats in BVSc and AH Course in the 3rd respondentorganization as per the procedure prescribed under the Indian Veterinary Council Act, 1984 and Veterinary Council of India Minimum Standards of Veterinary Education BVSc and AH Degree Course Regulations, 2016 as illegal and arbitrary.
Heard learned counsel for the petitioner.
Learned Standing Counsel Sri P.Govind Reddy for respondent No.2 submits that in pursuance to the notification dated 19-11-2016, all the three seats have been filled up and 1st Semister is also going to end by December, 2016 and he also produced a letter, dated 02-12-2016, of Sri Venkateswara Veterinary University stating that their university has decided not to take-up further admissions. In view of the same, no interim order can be granted. Even otherwise, the petitioner now complains that only registered candidates can participate in the counseling, but the petitioner has not questioned the notification dated 19-11-2016, but it specifically states all the eligible candidates can appear in the counseling. In fact, according to the learned Standing Counsel, the petitioner has participated in the counseling in pursuance to the notification dated 19-11-2016.
In view of the above facts and circumstances of the case, I do not see any merit in the writ petition.
Accordingly, the writ petition is dismissed. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
