HON'BLE SRI JUSTICE SAMUDRALA GOVINDARAJULU

Crl.P.No.5987 of 2012

O R D E R:

The petitioners 1 to 5/A.1 to A.5 are accused of offences punishable under Section 498-A IPC and Sections 3 and 4 of the Dowry Prohibition Act, 1961. It is contended by the petitioners' counsel that both the parties have compromised the matter and that they are leading their lives peacefully and that the 2 nd respondent gave affidavit to that effect. No matter is pending in this Court. The criminal case is pending before the Judicial Magistrate of the First Class, Kamalapuram. Therefore, it is open to both the parties to approach the lower Court and file appropriate petition in the lower Court for recording the alleged compounding of the offences, in which event, the lower Court will record statements of both the parties and in case he finds the same to be true and voluntary, then the Magistrate will record the same and compound the compoundable offences and will pass necessary order with regard to others.

Subject to above observations, this Criminal Petition is

disposed of.
