HON'BLE SRI JUSTICE DAMA SESHADRI NAIDU
WRIT PETITION NOs.9553 of 2014
ORAL ORDER:
Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for the respondents, apart from perusing the record.
Since the issue in the Writ Petition runs in a narrow compass, this Court disposes of the Writ Petition at the admission stage itself.
Shorn of extraneous particulars, the facts in brief are that the petitioners hail from founder families of Sri Venkateswara Swamy Temple, Sangameswarapalli Village and Sri Veerabhadra Swamy Temple of the same village, Hindupur Town respectively. Their grievance is that in view of their pre-occupations, they could not look after the affairs of the temples and accordingly, they have made numerous representations to the authorities to appoint Executive Officers to those temples since they have already been declared under Section 6 (c) of Act, 30 of 1997. The petitioners have also brought on record the fact that the temples have certain properties, including agricultural lands, and income generated therefrom has not been properly accounted for. Accordingly, the petitioners seek a direction to the respondents to explore the option of appointing Executive Officers to the respective temples.
The learned Assistant Government Pleader, on instructions, has fairly submitted that the authorities have already been seized of the issue and have been exploring all options to ensure that the interests of the temples have been protected.
In the light of the representation made by the respective counsel for the petitioner and the respondents, this Court deems it desirable to dispose of the Writ Petition with a direction to the respondents to consider the Representations dated 30.12.2013 made by the petitioners objectively and
pass appropriate orders thereof as expeditiously as possible.
With the above direction, the Writ Petition is disposed of. No order as to costs. The miscellaneous Petitions, if any, shall stand closed.
