which was got validated after the payment | |||
of stamp duty. It is further submitted that | |||
the memo dated 09.01.1985 was neither | |||
challenged by the petitioner nor his father | |||
and it is also pointed out that the writ | |||
petitioner was never in possession of the | |||
property<br>in<br>question<br>and<br>the<br>State | |||
Government was impleaded for the first | |||
time only in the year 2022. It is also urged | |||
that learned Single Judge ought to have | |||
appreciated that disputed questions of fact |
were involved which do not have been gone |

into in a proceeding under Article 226 of |
the Constitution of India. |
The writ appeal is therefore admitted |
for hearing. |
