THE HONOURABLE SMT. JUSTICE JUVVADI SRIDEVI CRIMINAL PETITION No.9966 of 2024 O R D E R:

Petitioners/accused Nos.2 & 4 have filed this petition under Sections 480 and 483 of Bharatiya Nagarik Suraksha Sanhitha, 2023, seeking bail in Cr.No.177 of 2024 of P.S. Manuguru, registered for the offences under Sections 8(c) r/w. 20 (b) (ii) (c), 27-A and 29 of the NDPS Act, 1985.

  1. Heard Sri P.Manoj, learned counsel for petitioners and Sri M.Ramachandra Reddy, learned Additional Public Prosecutor appearing for the State and perused the record.

  2. The case of the prosecution is that on 02.06.2024, accused persons were found in possession of 483.38 kgs. of ganja. Hence, the same was seized and the accused were arrested and remanded to judicial custody on the very same day.

  3. Learned counsel for petitioners submits that the petitioners/accused Nos.2 and 4 are innocent and have been

falsely implicated in the case. He further submits that ganja was seized from the possession of accused Nos.3 and 5, but not from the petitioners herein. He further submits that accused No.1 in the crime was already granted bail by the trial Court and most of the investigation in the case is completed, and hence, prayed for grant of bail.

  1. The learned Additional Public Prosecutor opposed the application stating that specific allegations are levelled against the petitioners/accused Nos.2 and 4. He further submits that investigation is pending and if the petitioners/accused Nos.2 and 4 are released on bail at this stage, they may tamper with the evidence and may commit similar type of offences, and hence, prayed to dismiss the petition.

  2. Having heard both sides and perused the material on record, it is apparent that major part of the investigation is completed and considering that the petitioners/accused Nos.2 and 4 are in jail since 02.06.2024, this Court is of the

considered view that it is a fit case for grant of bail subject to following conditions:

    1. The petitioners/accused Nos.2 and 4 shall be released on bail on each of them executing a personal bond for Rs.20,000/- with two sureties for the like sum each to the satisfaction of JFCM Court at Manuguru.
    1. The petitioners/accused Nos.2 and 4 shall comply with the conditions as laid down under Section 480(3) of Bharatiya Nagarik Suraksha Sanhitha, 2023.

Petition is allowed accordingly.
