COMMON JUDGMENT: (Per the Hon'ble Sri Justice Ashutosh Mohunta)

Since all these thirty three (33) appeals arise out of common notification dated 24.02.1999 and common award dated 15.09.1999 and the lands acquired are situated in Janampet Village of Pebbair Mandal for the public purpose of excavation of P.J.P. Canal, they are taken up together for disposal.

Learned counsel on either side submitted that the subject matter of these thirty three (33) appeals is squarely covered by the common judgment of this Court in L.A.A.S.No.925 of 2011 and batch dated 26.09.2013, whereunder this Court fixed compensation at Rs.65,000/ per acre for dry lands and Rs.75,000/- per acre for irrigated dry/wet lands with all the statutory benefits available under the amended provisions of the Land Acquisition Act, 1894 ("the Act" for brevity).

Following the same, all these thirty three (33) appeals are partly allowed awarding compensation to the claimants at Rs.65,000/- per acre for dry lands and Rs.75,000/- per acre for irrigated dry/wet lands. The claimants are further entitled to all the statutory benefits as per the amended provisions of the Act. They shall also be entitled to interest from the date of issuance of notification under Section 4 (1) of the Act and not from the date of taking of possession. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
