Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to permitted to erect the Transmission Towers and complete the stringing of lines in the land of the Endowment Department, The State of Telangana which stands in the name of the 3rd Respondent situated in Sy. No. 208, 210 and 214 of Marepally Village Anumula Mandal, Nalgonda district, pending disposal of WP No. 26677 of 2021, on the file of the High Court.

The court while directing issue of notice to the Respondents herein to show cause as to why this application should not be complied with, made the following. (The receipt of this order will be deemed to be the receipt of notice in the case).

ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Endowments appearing for respondent Nos.1 and 2 and perused the record.

It is brought to the notice of this Court that, in similar circumstances, a Division Bench of this Court in W.A.No.335 of 2021 directed the Transmission Corporation of Telangana Limited, which is also the petitioner in this case, to deposit the compensation in respect of the land, wherein the transmission tower is to be erected.

Sri R.Vinod Reddy, learned standing counsel, representing the petitioner, would submit that even in the present case, the petitioner-Corporation is willing to deposit the compensation as determined by the revenue authorities in respect of the land of the $3^rd$ respondent - temple, wherein the transmission tower is to be erected.

Having regard to the said submission made, the learned Government Pleader appearing for respondent Nos.1 and 2 submits that if such compensation is deposited by the petitioner Corporation to the credit of the 3^rd respondenttemple, respondent Nos.1 and 2 have no objection for erection of the transmission tower by the petitioner.

In view of the same, pending further orders the petitioner is permitted to erect the tower in the land of the $3^rd$ respondent – temple, subject to deposit of compensation as determined by the revenue authorities to the credit of the 3^rd respondent – temple.

Upon determination of the compensation to be deposited by the revenue authorities, the $3^rd$ respondent - temple shall intimate the bank account details to enable the petitioner Corporation to deposit the said amount. Only upon such deposit of the amount by the Corporation, the petitioner shall proceed with further work on the site of the $3^rd$ respondent-temple.
