WRIT PETITION No.21493 of 2023
ORDER:
The writ petition, under Article 226 of the Constitution of India, is filed by the petitioners, seeking the following relief:
"...to issue a writ or order more particularly one in the nature of writ of mandamus declaring action of the $5<sup>th</sup>$ respondent in not registering F.I.R against the respondents 6 to 11 and their henchman and not causing arrest of the respondents 6 to 11 and their henchman inspite of receipt of the petitioner written complaints dated 27-05-2023 and 21-11-2022 as illegal, Arbitrary, unjust and against the provisions of CRPC and IPC and also against Article 21 of Constitution of India..."
$\overline{2}$ . Heard the learned counsel for both sides and perused the record.
$\overline{3}$ . The grievance of the petitioner in this writ petition is that he lodged complaint dated 27.05.2023 on the file of respondent No.5 against the respondent Nos.6 to 11 and requested to take necessary action but till date the respondent No.5 is not registering any case or conducting any investigation.
The $4.$ learned Assistant Government Pleader for Home appearing for the respondent Nos.1 to 5 has submitted that contents of the complaint submitted by the petitioner revealed that there are matrimonial disputes between the petitioner and the
respondent No.6 and as such the respondent No.5 has not registered any case and advised the petitioner to approach the Family Counseling Centre or concerned Family Court for redressal of his grievance.
In view of the above submissions, this Writ Petition is closed 5. as no further orders are necessary.
As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed. No order as to costs.
