Petition under Article 226 of the constitution of lndia praying that in the circumstances stated in the affidavit filed therewith, the High court may be pleased to issue a writ or order more particularly on in the nature of writ of mandamus declaring the action of the 2'd Respondent in not issuing Mutation proceedings, Entry in Dharani portal, E-pahani and pattedar passbook and rifle deed in respect of the Petitioner landed property covered by Survey No. 26714, Admeasuring Ac.1.00.Guntas and Survey No. 267tAA Admeasuring Ac.1.00.Guntas , thus totally admeasuring Ac.2.00.guntas situated at Morangapalle Village and Gram Panchayat, Mominpet Mandal, vikarabad District inspite of receipt of the petitioner ontine Application Nos. 2200021431 and 2200021432, dated 1-3-2022 as iilegal, arbitrary, unjust and also against Article 14,16,19,21 and 300 A of constitution of lndia and also against the provisions of TSRORAct'1971 and Rules 1989.

THE HON'BLtr SRI JUSTICB B. VIJAYSEN REDDY WRIT PETITION No.20465 of 2023 ORDER: (ORAL)

The writ petition is filed by the petitioner sceking to declare action of respondent No.2 in not considering Dharani application of the petitioner dated 01.03.2023 seeking mutation and issuance of pattadar passbook and title in respect of the land total admeasuring Ac.2.00 guntas in Sy.Nos.267lA and267lAA situated at Morangapalle Village, Mominpet Mandal, Vikarabad District, as illegat and arbitrary.

2. Heard learned counsel for the petitioner and the leamed Assistant Govemment Pleader for Revenuc appcaring for the respondents and perused the material available on record.

[t is the case of the petitioner that he is the absolute owner and possessor of the above referred land having acquired the samc by virtue of registered gift settlement deed bearing document No.5440 of 2006 dated t7.10.2006 executed by Smt. Anjamma W/o.Narsaiah. The petitioner was issued manual pattadar passbook and title under the provisions of ROR Act, 1971. On introduction of Dharani portal, the petitioner intended to get e-passbook and submitted application

No.220002143 dated 01.03.2023 seeking mutation and for assuance of pattadar passbook in respect of the subject land.

4. Learned Assistant Government Pleader for Revenue submits that appropriate act on will be taken on online application submitted by the petitioner.

5. Recording the above submissions, the writ petition is disposed of directing the respondents to consider Dharani application No.220002143 dated 01.03.2022 submitted by the petitioner in respect of the land to il admeasuring Ac.2.00 guntas in Sy Nos.267/A and 267/AA situa et Morangapalle Village, Montir pet Mandal, Vikarabad Disciet, by issuing notice to all the interested/affected persons and pass orders, in accordance with law, within a period of forty five (45) lays from the date of receipt of a copy of this order. There shall be 1 5 order as to costs.

As a secuel thereto, miscellaneous petitions, if any, pending in this writ petitio, shall stand closed.
