The writ petition is filed to declare the action of the respondents in taking possession of the land of the petitioner as illegal, arbitrary and unconstitutional and consequently to direct the respondents to pay compensation of Rs.150/- per sq.lyard for having built a road across the land in survey no.202 of Ballepalli village, Khammam Urban Mandal, Khammam district to an extent of Ac:0-20 gts belonging to the petitioner or in the alternative initiate appropriate proceedings under the provisions of A.P.Land Acquisition Act and pay compensation in terms of the said Act.

When the matter is listed today for hearing, the learned standing counsel for the respondents submits that the Mandal Revenue Officer, Khammam Urban, submitted Proceedings ROC.No.B/7385/2000 stating that the Mandal surveyor has inspected the site and reported that the land pertaining to the petitioner in survey no.202 is not coming under the road. The road was formed in the land of other ryots in the same survey no.202.

Recording the above submission, the writ petition is dismissed as infructuous. No costs.
