Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to issue lnterim Direction directing the respondents to forthwith consider the case of the petitioner for promotion to the post of Deputy Executive Engineer without reference to the vigilance report no 14 (C.No.280A/7ElE.lll/2019) dated 1310212020, in view of report submitted by the Vice Chairman and managing Director dated 10/06/2020 and 1911212020, Pending disposal of WP No '1 9169 of 2022, on the file of the High Court.
The court while directing issue of notice to the Respondents herein to show cause as to why this application should not be complied with, made the following order.(The receipt of this order will be deemed to be the receipt of notice in the case). The Court made the following
ORDER
The learned counsel for petitioner submits that in similar circumstances, this Court granted interim order dated 23.2.2022 in l.A.No.1 of 2022 in W.P.No.9270 of 2Q22.
Hence, there shall be interim direction as prayed for. However, such promotlon shall be subject to the outcome of the departmental enquiry initiated against the petitioner.
Mr.B.Shiva Kumar, learned Standing Counsel takes notice on behalf of respondent No.2 and seeks time to file counter.
Post the matter on 28.6.2022.
