CONTEMPT CASE No.1696 of 2015

ORDER: (Per the Hon'ble the Acting Chief Justice Ramesh Ranganathan)

The respondent-contemnor is present in Court.

This contempt case is filed alleging violation of the order passed by a Division Bench of this Court in W.P.No.3588 of 2013 dated 14.02.2013 directing status quo as on that date to be maintained with regards the cancellation deed dated 17.10.2012 bearing document No.6803/2012 registered in the office of the Joint Sub-Registrar-I, Vijayawada. The complaint in this contempt case is that, after the order of status quo was passed, the writ petitioner had executed an agreement of sale in favour of one Sri Marupilla Ravi Kumar, son of Ayyanna, and had registered the same in the office of the Joint Sub-Registrar, Vijayawada as document No.6204/2014 on 23.06.2014.

As registration of the said agreement of sale is in violation of the status quo order passed by this Court, contempt proceedings was initiated against the petitioner in the writ petition, and a notice in Form-I was also issued to him.

Sri C.B.Adarsh Kumar, learned counsel for the respondent-writ petitioner, submits that the respondent-writ petitioner has subsequently executed a cancellation deed bearing No.6134/2017 dated 08.06.2017 registered in the office of the Joint Sub-Registrar, Vijayawada cancelling the agreement of sale bearing document No.6204/2014 dated 23.06.2014.

As the respondent-contemnor has expressed her unconditional apology before this Court and as she has, by cancelling the earlier document bearing No.6204/2014 dated 23.06.2014, purged herself of contempt, we see no reason to proceed further against her under the Contempt of Courts Act.

The Contempt Case is, accordingly, closed. Miscellaneous Petitions pending, if any, shall also stand closed. There shall be no order as to costs.
