Petition Under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ order or direction especially one in the nature of Writ of Mandamus declaring that, a) the action of the Respondents in not making payment of terminal benefits to the Petitioner in pursuance of letter/ proceedings issued by the 3rd Respondent in Lr.No.PAG (A and E)/P17/II/R-173/ SP88/2024-2 /909 dated 19.06.2024 is illegal, arbitrary and discriminatory, violating Article 14,
<sup>16</sup>and 300.A of the constitution of India b) further decrare that, the Respondents sha' forthwith rerease a, terminar benefits payabre to the petitioner incruding Death-cum-Retirement, Gratuity, commutation of pension, Generar provident Fund amount and encashment of Earned Leave and Earned Leave amount and other benefits in pursuance of his retirement dated 31 .05.2024 and the proceedings in Lr.NopAG(Aand E)tp,t7ill/R_173tSpBBt2O24-2 /9Og dated <sup>19</sup>06 2024 cf the 3rd Respondent c) the Respondents have no right or power ro withhord the rermrnar benefits payabre to the petitioner after his retirement.

ORDER
With the consent of both the parties, this Writ Petition is taken up for disposal, at the admission stage.
- Heard Mr. G.Jalpath Reddy, learned counsel for the petitioner, learned Government Pleader for Finance appearing for respondent Nos.1, 4 and 5, learned Government Pleader for Commercial Taxes Department appearing for respondent Nos.2 and 6, Mr. K. Bala Krishna, Iearned Standing Counsel for Accountant General appearing for respondent No.3.

Learned counsel for the petitioner submits that the petitioner retired from service on 3L.O5.2024. Considering the pension proposals, respondent No.3 sanctioned pension to the petitioner vide Letter dated 19.06.2024. However, till now, his retirement benefits were not released by the respondents.

Learned Government Pleader submits that due to dearth of funds, the amounts could not be released to the petitioner, on time. However, in pursuance of Letter, dated 19.06.2024, amounts will be released to the beneficiaries.
Having regard to the above made submissions, this Writ petition is disposed of directing the respondents to release retirement benefits to the petitioner in pursuance Letter No.PAG(A&E)/P17/II/R-173/SP88/2024-02/909, of 19.06.2024, issued by respondent No.3, as expeditiously as dated possible, preferably within a period of ten (10) weeks from the date of receipt of a copy of this order. There shall be no order as to COSts.
Miscellaneous petitions pending, if any, shall stand closed.
