THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.8056 of 2016

ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:

"to issue writ of Mandamus to declare the action of the 2nd respondent in not allowing petitioner to discharge her duties as Deputy Chief Accounts Office (ST,P&A CE) TS head office bus bhavan, Hyderabad as illegal arbitrary and contrary to the provisional allocation made under the provisions of AP Reorganization Act, 2014 and consequentially direct the 2nd respondent to allow the petitioner as a Deputy Chief Accounts Officer (ST,P&A,CE), RTC Telangana State."

Heard, Sri P.R.K. Amarender Kumar, learned counsel for the petitioner, Sri A. Rama Rao, learned Sanding Counsel for respondent No.1 and Sri N. Vasudeva Reddy, learned Standing Counsel for respondent No.2.

When the matter is taken up, it is submitted by learned counsel for the petitioner that for redressal of the grievance of the petitioner herein, the petitioner herein will make necessary application before the 2 nd respondent and the same may be directed to be disposed of by the 2 nd respondent, in accordance with law, by fixing some timeframe. The said request is not opposed by learned Standing Counsel for respondents and this Court considers the said request as reasonable.

Recording the said submission and having regard to the nature of controversy, the writ petition is disposed of, without

expressing any opinion on the merits of the matter and entitlement of the petitioner, keeping it open for the petitioner herein to make necessary application before the 2 nd respondent for redressal of her grievance within a period of two (2) weeks from the date of receipt of a copy of this order and if any such representation is made within the time stipulated the same be considered and appropriate orders be passed by the 2 nd respondent, in accordance with law, within a period of two (2) weeks thereafter.

Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
