THE HON'BLE SRI JUSTICE K.C.BHANU

WRIT PETITION NO.20062 OF 2012

ORDER:

This Writ Petition is filed to issue a writ of Mandamus declaring the action of the respondent in not refunding the amount of Rs.87,00,000/- to the petitioner, which was paid by the petitioner as security deposit i.e., Rs.6,00,000/- for the years 2008-2010 and Rs.81,00,000/- for the years 2010- 2012, in respect of leasehold rights granted in their favour pertaining to Reach No.8 of Amaravathi Village and Mandal, Guntur District and in not disposing of the representation made by the petitioner on 10.04.2012, as arbitrary and illegal and consequently direct the respondent to forthwith consider the representation of the petitioner and refund the amount of Rs.87,00,000/- to it.

The petitioner society was granted leasehold rights by the respondent for quarrying sand in respect of the above reach for the periods from 2008- 2010 after remitting requisite lease amount along with security deposit of Rs.6,00,000/-. Even after subsequent period also tenders were called for and the petitioner society was awarded lease for the years 2010-2012 i.e.. 01.04.2010 to 31.03.2012 and accordingly, the petitioner society deposited requisite lease amount along with the security deposit of Rs.81,00,000/-. The lease of the petitioner society expired by 31.03.2012. Therefore, the petitioner society requested the respondent to refund the security deposit amount. The petitioner society also filed representation, dated 10.04.2012 to refund the security deposit as earlier as possible. But, so far as no action has been taken.

  3. Appropriate decision has to be taken by the respondent. Therefore, the respondent is directed to consider the representation of the petitioner, dated 10.04.2012, and pass appropriate orders in accordance with law within a period of four weeks from the date of receipt of a copy of this order.

  4. With the above direction the Writ Petition is disposed of. There shall be no order as to costs.

  5. Miscellaneous petitions, if any, filed in this writ petition shall stand closed.
