HON'BLE SRI JUSTICE B.SESHASAYANA REDDY Criminal Petition No.1176 of 2013
ORDER:-
The petitioners apprehend arrest in Crime No.54 of 2012 of Mominpet Police Station, Rangareddy District, registered for the offence under Sections 353 and 506 of I.P.C.
The accusation made against the petitioners is that they beat the audit party indiscriminately and made them to leave the village without conducting the audit. The said incident has been witnessed by LW3-Madarapu Vishnu and LW4-Laxmigari Mallesham.
Heard learned Counsel appearing for the petitioners and learned Additional Public Prosecutor appearing for the respondent-State.
It is contended by the learned counsel appearing for the petitioners that the petitioners are innocent and they have been falsely implicated in this case and therefore, the petitioners deserve for grant of anticipatory bail.
Learned Additional Public Prosecutor appearing for the respondent-State opposed the application.
As seen from the material placed on record, the incident is witnessed by LW3-Madarapu Vishnu and LW4-Laxmigari Mallesham. Police completed the investigation and filed the charge sheet. The petitioners having successful in avoiding the investigating agency, approached this court seeking anticipatory bail after the charge sheet is filed. In view of the specific accusations levelled against the petitioners, I am of the view that the petitioners do not deserve for grant of anticipatory bail.
Accordingly, the Criminal Petition is dismissed.
