ORDER:
This writ petition has been filed by Sri A.Suresh assailing the action of the respondents in not considering the application filed by him for renewal of the form 2B licence for the excise year 2010-11 as illegal and arbitrary.
The petitioner possessed form 2B licence under the provisions of A.P.Excise (Grant of Licence of selling by Bar and Conditions of Licence) Rules, 2005 in the year 2006-07. He got licnece renewed for the excise years 2007-08, 2008-09 and 2009-10. He conducted the business for the excise years 2007-08 and 2008-09. Though the petitioner got licnece renewed for the excise year 2009-10, he could not conducted the business. The reasons for not conducting the business are not much relevant for the purpose of this case.
It is suffice to say that the petitioner filed an application dated 11.6.2010 for renewal of the form 2B licnece for the excise year
2010-11 and the said application is stated to be pending. There being no action on the said representation, the petitioner approached this Court invoking jurisdiction under Article 226 of the Constitution of India with a prayer stated supra.
When the writ petition came up for admission, the learned Assistant Government Pleader for Prohibition & Excise takes notice on behalf of the respondents.
Heard learned counsel appearing for the parties.
The limited grievance of the petitioner is that the respondents are not taking any decision on his application dated 11.6.2010 for renewal of form 2B licence for the excise year 2010-11.
In that view of the matter, the writ petition is disposed of directing the respondents to consider the application dated 11.6.2010 filed by the petitioner for renewal of from 2B licnece for the excise year 2010-11 and pass appropriate orders in accordance with the Rules in operation within a period of four weeks from the date of receipt of a copy of this orders. No costs.
