WRIT PETITION No.13207 of 2006 O R D E R:

Heard the learned counsel for the petitioner and the learned Government Pleader for Prohibition and Excise appearing for the respondents 1and 2.

The only grievance of the petitioner in this writ petition is that the respondents 1 and 2 are contemplating to grant a licence in favour of the third respondent in violation of the provisions of the Andhra Pradesh Excise (Grant of licence of selling by Bar and conditions of licence) Rule, 2005. It is alleged that the Bar proposed to be operated by the third respondent is located within 100 meters from a Mosque and that though the petitioner made a representation dated 26-06-2006 bringing the said fact to the notice of the respondents 1 and 2, no action has been taken.

Having regard to the fact that the representation dated

26-06-2006 submitted by the petitioner was received by the respondents 1 and 2 on that day itself and the same is pending consideration, without expressing any opinion as to the correctness of the allegations made, the writ petition is disposed of with a direction to the respondents 1 and 2

to consider the objections raised by the petitioner and to pass appropriate orders in accordance with law after affording due opportunity to the third respondent to put forth his version. No costs.
