This Petition coming on for hearing, upon perusing the Memorandum of Grounds of Criminal Petition and upon hearing the arguments of Mr. G, Narayana, Advocate for the Petitioner and the Mr. Jithender Rao Veeramalla Additional Public Prosecutor on behalf of the Respondent No.1 and of None appeared for the Respondent No. 2.

This petition is filed seeking quashment of the C.C.No.2881 of 2024 on the file of X Additional Chief Metropolitan Magistrate at Secunderabad, against the petitioner/accused No.2.

  1. Heard Mr.G.Na@yana, learned counsel for petitioner and Mr.Jithender Rao Veeramalla, learned Additional Public Prosecutor appearing for the respondent No.1-State

  2. The petitioner is arrayed as accused No.2 in C.C.No.2881 of 2024 for the offence under Section 381 r/w. 34 of lPC.

  1. Learned counsel for the petitioner would submit that though the petitioner is resolved to face the proceedings, his presence before the trial Court on each adjournment is causing severe hardship and effecting his employment. Therefore, prayed for dispensing his personal presence unless it is required for the proceedings and such direction would redress his grievance. However, undertakes to personally appear as and when directed by the trial Court

  2. Learned Additional Public Prosecutor submits that there is no specific objection for the prayer, however pleaded for a direction for in person presence of the petitioner in the material stages of the proceedings

  3. Having regard to the submissions, subject to the petitioner's appearance through his counsel on every adjournment and the petitioner's personal appearance as and when directed by the Court, the personal presence of the petitioner in the proceedings of the C.C.No.2B81 of 2024 on the file of X Additional Chief Metropolitan Magistrate at Secunderabad, ts dispensed with. Additionally it is specified that any lapse in abiding the above conditions would render this order ineffective
