PROCEEDING SHEET

Sl.DateORDEROFFICE
NOTE
No.
1.20.03.2023HCJ & NTRJ
I.A.No.1 of 2023Transferred to
i/o folder,
before
corrections, if
any.
Heard
Mr.
Parsa
Ananth
Nageswar
Rao,
learned Government Pleader attached to the office of
learned Advocate General for the appellants and
Mr.
Rajendra
Kumar,
learned
counsel
for
respondents No.1 and 2.
This interlocutory application has been filed
for condoning the delay of 203 days in filing the
related appeal against the order dated 13.04.2022
passed
by
the
learned
Single
Judge
in
W.P.No.12798 of 2021.
We have perused the supporting affidavit.
In paragraph 18 of the said affidavit it is
stated as follows:
It is respectfully submitted that the
copy of the judgment in the writ petition
was received in the office of the District
Collector,
Ranga
Reddy
District,
on
27.07.2022 and in the office of Special
Deputy
Collector,
Urban
Land
Ceiling,
Ranga Reddy District on 16.08.2022. The
delay is neither deliberate nor intentional
but only due to the aforesaid reasons and I
have been advised that this Court has
ample powers of condone delay. If the said
delay were to be condoned it would not
cause any loss or prejudice to the other
side but would only enable the matter to
be heard and decided on merit.
Hence is
this application seeking condonation of
delay in filing the above appeal.
We are of the view that the above averments
are wholly inadequate to justify the inordinate delay
of 203 days.
However, we grant liberty to the appellants to
file a better affidavit to explain the delay.
List again on 03.04.2023.
