Petition under Article 226 of the constitution of India praying that in the circumstances stated in the Affidavit filed herein the High Court may be pleased to issue writ direction or order more particularly writ of Mandamus declaring the action of the respondents in not paying the petitioner an amount of Rs.1,99,485/- together with interest as per Measurement Book vide Book No. 18248/AH from page 14 to 22 as being illegal, arbitrary, and violative of Arts. 14, 21 & 300 (A) of the Constitution of India and as also the provisions of A.P. Panchayat Raj Act, 1994 and pass such other orders.

ORDER:

The petitioner claims that as per the resolutions of respondents 3 and 4, he fitted the electric current single phase motor including all accessories in Ward No.10 of Gram Panchayat, Ibrahimpatnam, Ranga Reddy District, under the Scheme of R.W.S. for the academic year 2004- 05, incurring an amount of Rs.1,99,485/-. The main grievance of the petitioner is that though the said works executed by him were recorded in the measurements book, the respondents are not disbursing the amounts to which he is entitled to.

A detailed counter affidavit is filed by respondent No.2, wherein it is stated that the records were traced in the office of the 1 st respondent and a communication was addressed to the Gram Panchayat of Ibrahimpatnam on 20.06.2009 directing it to make payment to the petitioner and, accordingly, an amount of Rs.1,99,485/- was paid to the petitioner by way of cheque No.000401, dated 22.06.2009, for Rs.99,485/- and cheque No.000402, dated 22.06.2009, for Rs.1,00,000/ and, as such, the total amount has been paid to the petitioner, for which the petitioner also acknowledged the receipt of the same on 22.06.2009.

In view of the aforesaid counter averments of the 2 nd respondent, no further orders are required to be passed in this writ petition.

Accordingly, the writ petition is closed. No order as to costs.
