Writ Petition No.26337 of 2012

ORDER:

The petitioner submitted an application before the Tahasildar, Khajipet, the 3 rd respondent herein, with a request to issue pattadar pass book and title deeds, in respect of Acs.4.42 cents of land, in different survey numbers of Pottur Revenue Village, Khajipet Mandal, Kadapa District. It is stated that after processing the application, the 3 rd respondent issued pattadar pass book and has forwarded the title deeds for approval and endorsement by the Revenue Divisional Officer, Kadapa, the 2 nd respondent herein. The grievance of the petitioner is that the 2 nd respondent has not accorded approval so far.

Heard learned counsel for the petitioner and learned Government Pleader for Revenue.

The A.P. Rights in Land and Pattadar Pass Books Act, 1971 and the Rules made thereunder prescribe a detailed procedure for issuance of pattadar pass books and title deeds. While the Tahasildar happens to be the final authority for issuance of pattadar pass books, endorsement/approval of Revenue Divisional Officer is required for title deeds. It is in this process that, the title deeds in respect of the lands applied for by the petitioner were forwarded to the 2 nd respondent. Unless the title deeds are issued, the process would be incomplete. The

2 nd respondent cannot keep the matter pending indefinitely.

Hence, the writ petition is disposed of, directing the 2 nd respondent to take necessary steps and pass final orders as regards issuance of title deeds to the petitioner within a period of four (4)

weeks from the date of receipt of a copy of this order.

The miscellaneous petition filed in this writ petition also stands disposed of.

There shall be no order as to costs.
