WRIT PETITION No.17728 OF 2007

ORAL ORDER:

This writ petition is filed seeking a declaration that the action of the 1 st respondent-Director of Civil Supplies in not passing any order on the application for stay filed by the petitioner along with Appeal against the order of the 2 nd respondent dated 9.7.2007 as arbitrary and illegal.

The petitioner states that, in the meanwhile, the 1 st respondent has issued a notification dated 27.7.2007 for appointment of a dealer for the newly constituted shop and interviews are scheduled to be conducted on 23.8.2007.

Having heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies appearing for the respondents, though I am not inclined to express any opinion on merits, since the statutory Appeal is pending before the 1 st respondent, I deem it appropriate to dispose of the writ petition with a direction to the 1 st respondent to dispose of the application for stay filed by the petitioner following due process of law as expeditiously as possible preferably within a period of one week from the date of receipt of a copy of this order . In the meanwhile, it is open to the respondents to proceed with the selections pursuant to the notification, dated 27.7.2007, but the appointments shall not be finalized till appropriate orders are passed by the 1 st respondent as directed by this Court. No costs.
