CRIMINAL PETITION No.8984 of 2011

ORDER:

The petitioner preferred this Criminal Petition to quash the First Information Report in crime No.45 of 2010 of Tirumala II Town P.S., Tirupati, registered for the offences under Sections 408, 420, 467, 468, 471, 477 and 120B of the Indian Penal Code, 1860, whereby the petitioner was arrayed as accused No.2.

Learned counsel for the petitioner submitted that even though the name of the petitioner did not find place in the First Information Report, his name is included in the remand report along with the other accused. Further, it is submitted that there is any apprehension of arrest of the petitioner in the hands of the respondent-police and hence he prays to allow the petition.

On perusal of the entire material available on record, this Court is of the view that it is not an apt stage to interfere with the investigation of the case. However, taking into consideration of the facts and circumstances of the case, the petitioner is directed to file an application seeking anticipatory bail before the concerned District and Sessions Judge and on such filing of the application, the concerned learned District and Sessions Judge, shall consider the same favourably.

With the above observations, the Criminal Petition is disposed of.

Miscellaneous Petitions filed in this Criminal Petition, if any, shall stand closed.
