WRIT PETITION No.46292 of 2016

ORDER:

1. Heard learned counsel for the petitioner and Government Pleader for Revenue. With the consent of both the parties, the writ petition is being taken up for disposal at the admission stage itself.

2. The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents in trying to take over the petitioner's land to an extent of Ac.2.00 in Sy.No.951 of Tirupathi Town, Chittoor District, without following due process of law, as illegal, arbitrary and un-constitutional; and consequently direct the respondents not to take over the above said land without following due process of law.

3. Though various grounds are raised learned counsel for the petitioner restricts his prayer seeking a direction to the respondents to follow due process of law.

4. Having regard to the facts and circumstances of the case and without going into the merits of the case, the present writ petition is disposed of, directing the respondents not to interfere with the subject property except in accordance with the due procedure established under law. No order as to costs.

5. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
