HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE

AND

HON'BLE SRI JUSTICE S.V. BHATT

PIL No.279 OF 2014

PC: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale)

Heard learned counsel for the parties.

The petitioner, in the instant petition, seeks to challenge inaction on the part of the State of Telangana and the State of Andhra Pradesh in taking appropriate steps for implementing GUR (Regulation of use) Order, 1968 and further in not taking steps for purchase of black jaggery in terms of guidelines issued under G.O.Ms.No.87, dated 16-02-2012. The petitioner also seeks direction to the respondents to implement the guidelines issued under the said GUR Order for procurement of black jaggery to prevent its diversion for the purpose of manufacture of illicit liquor.

We have perused G.O.Ms.No. 87 dated 16-02-2012, which speaks about the scheme for purchase of black jaggery directly from the farmers. The G.O was issued to prevent misuse of black jaggery for manufacturing illicit liquor.

On last occasion, a statement was made on behalf of the State of Telangana that the Purchase Committee for purchasing black jaggery, as provided under the scheme, has been constituted at AMC Yard, Kamareddy. The documents in support of the statement were also taken on record and since they were not furnished to the advocate for the petitioner, hearing of the petition was adjourned. At this stage, it is made clear that the petition was not pressed against respondent Nos.1, 3, 5 and 7.

Learned counsel for the petitioner submits that the petitioner would be satisfied if directions are issued to the State of Telangana to follow the guidelines contemplated by the G.O

dated 16-02-2012 scrupulously.

Learned Government Pleader appearing for the State of Telangana submits that since the Committee to purchase is available, it shall take all steps to purchase black jaggery from the farmers in the State during this and also coming seasons. He submits that the State of Telangana shall also take all care to see that every year Committee shall be constituted before commencement of the season and shall take all steps to purchase black jaggery, as provided for under the scheme, directly from the farmers in the State. His statements are recorded and accepted

In view of the above, learned counsel for the petitioner does not press this petition.

Hence, the petition is disposed of as not pressed.

It is needless to mention that the concerned authority shall take all necessary steps to implement the guidelines.

Consequently, miscellaneous petitions, if any, also stand disposed of.
